Some Practical Thoughts on Planning After the American Taxpayer Relief Act of 2012

Description:  The American Taxpayer Relief Act of 2012 (ATRA) has introduced a “new normal” for estate planning professionals and clients by providing much-anticipated transfer tax certainty, large indexed transfer tax exemptions, and portability of exemptions.  This discussion will address how estate planning professionals are adapting to ATRA, what steps we should be taking to adapt our practices and forms, pitfalls to avoid, and strategies to consider moving forward.

 

Presenters:

Gregory N. Barrick

Greg Barrick currently is a Partner and Chair of the Estate Planning Section in the law firm of Durham Jones & Pinegar.  Greg started his practice in Los Angeles, California, with Gibson, Dunn & Crutcher, and later worked with Van Cott, Bagley, Cornwall & McCarthy in Salt Lake City), before joining Durham Jones & Pinegar.  Greg is a Fellow and a Member of the Business Planning Committee of the American College of Trust and Estate Counsel (“ACTEC”).  He served as the ACTEC State Chair for Utah from 2008 to 2013 and as a Member of its State Chair Steering Committee from 2012 to 2014.  He currently is a Member of ACTEC’s Nominating Committee.  He also has been an Adjunct Professor at the University of Utah, David Eccles School of Business, where he taught Business Law.  He has been recognized in Who’s Who in North America, Best Lawyers in America, Mountain States Super Lawyers and Utah Business (Utah’s Legal Elite) in the fields of Trusts & Estates and Tax.  His practice concentrates on sophisticated business and estate planning for individuals and closely held companies, working on strategic family wealth planning and preservation, asset protection, gifting, business formation and succession planning, etc.  He received both his undergraduate degree (1979) and his law degree (1982) from Brigham Young University.

 

Matthew F. Hafen

Matt is a native of Southern Utah and is an associate in the St. George office of the law firm of Durham Jones & Pinegar.  He assists clients throughout Utah, Nevada, Arizona and California on a variety of matters including trust, estate, and business matters, the development and implementation of estate plans, wealth-transfer strategies, asset protection planning, business-succession plans, gift plans for families for effective gift and estate tax planning, and the formation, governance, and sale of business entities.  Matt offers practical advice to families and business owners to help each of his clients ensure that their vision for the future is achieved. He has served on the Board of Directors of the Southern Utah Estate Planning Council since 2014.  He received his law degree from Brigham Young University and has a Masters of Accountancy from Southern Utah University.
